Federal Constitution of Malaysia, Part II - Fundamental Liberties, Article 5 states that "No person shall be deprived of his life or personal liberty save in accordance with law".

Nevertheless, this Article 5 of the Federal Constitution has been violated. The highest Rule of Law of Malaysia, once again, has been raped and humiliated by their very own guardians and enforcers of the Law.

A wantonly cruel act which disregarded and ignored the supremacy of basic Law and human civilisation has been committed. The fundamental presumption of being innocent until proven guilty has been ravished and seems to have no application in our police stations.

Even before we digest the barbarian act upon one B Prabakar, even before we discover the whereabouts of one Solomon who is still missing in action, our hearts have been wrenched by the death of one Kugan Ananthan.

This 22 year-old-youth was detained on suspicion of being involved in stealing luxury cars. At the point of his death, he was just a suspect.

Selangor police chief DCP Khalid Abu Bakar, said that soon after his arrest on Jan 15 for suspected car thefts and on questioning him, police recovered a stolen Toyota Camry and a Honda Accord.

He said police further recovered 13 stolen cars based on information gathered from Kugan. Khalid said the deceased was allegedly involved in several cases of car thefts in the Klang Valley and Johor.

Alleged means declared but not proven. Is Khalid trying to equate him with guilt? Who is Khalid to do that? Why is he playing the role of a judiciary?

The law would have punished Kugan with up to 7 years in jail if he was charged and found guilty under Section 379A for theft of a motor vehicle. Otherwise, he would have end up in prison for 10 years, if he was charged and found guilty under Section 392 for robbery.

Till his last breath, he was innocent of any charge as he was a mere suspect. Whatever the charge and whatever the findings of the judge in the future, rest assured, it will not be as costly as his life.

So, who took the law into their own hands by killing Kugan? What a shame to know that his death occurred in police custody. Where is the integrity of our police force?

Dearest Malaysians, the person who died was not only Kugan. The person who died was not only a youth. The person who died was not only an Indian. The person who died is a Malaysian.

With him, a mother's love died. With him, a father's hopes died. With him, the desire of a family died. With him, the trust upon our police force died. With him, the expectation of police fairness and integrity died.

Where is Kugan's liberty to live? Where is Kugan's constitutional rights? Where is Kugan's basic human rights?

Remember, Kugan’s death is not magic or mere illusion. To the people responsible I say: When you look in the mirror, it will remind you. When you turn to your loved ones, it will remind you. When you look at your brothers, sisters or even your very own, beloved child, it will remind you of the brutal death of a young man.

The tears of a mother will haunt you. The shattered hopes of a father will curse you. The love of a family will evade you. You will not sleep peacefully.

We are not being emotional. Neither are we worked up. We are just sending a message to highlight that someone is watching you. This message is not only intended for the main culprits but to anyone who is trying to conceal or cover up the whole issue.

When the truth has failed, when the evidence has been buried and when the justice has been blindfolded, we will have to place our trust in the Almighty. May Kugan rest in peace.
