On the second day of cross-examination, chief inspector Azilah Hadri, the murder accused, vehemently denied he was with corporal Sirul Azhar Umar at Puncak Alam for about 45 minutes where Altantuya Shaariibuu was murdered on that night.

This was despite his cell phone records indicating he had received calls or made calls while he was on his way to the crime scene or was at the crime scene.

mongolian woman bombed altantuya 081106Azilah, 32, who was answering questions from DPP Tun Majid Tun Hamzah and Shah Alam High Court judge justice Mohd Zaki Md Yasin, maintained his reply that he was with his fiancee Norazila Omar and later with girlfriend Lance Corporal Rohaniza Roslan on the night of the incident.

The accused who is a member of the elite Special Action Squad also disagreed with suggestions by Tun Majid that he had already conspire with Sirul Azhar in his mission to kill and destroy Altantuya while the two were at political analyst Abdul Razak Baginda's house in Bukit Damansara.

He, however, agreed that he, Sirul and Rohaniza had brought Altantuya to Bukit Aman. But, he denied that he and Sirul had brought Altantuya to Sirul's jeep where the three of them travelled from Bukit Aman till Puncak Alam and this ended with the Mongolian being murdered.

Pistol kept at Bukit Aman

At times frowning when replying to questions from Tun Majid, Azilah also disagreed he had his Glock pistol with him the whole night, while he had picked up Altantuya at the political analyst's house and until the time of Altantuya's death on the early morning of October 20, 2006.

altantuya trial 160707 azilahAzilah (pic) and Sirul Azhar are both jointly charged with murdering Altantuya, 28, at a location between Lot 12843 and Lot 16735 in Mukim Bukit Raja, Selangor between 10am on Oct 19, 2006 and 1am the following day.

The chief inspector maintained that his pistol was kept at Bukit Aman with one sub-inspector Megat Rosli before he picked it up after midnight on October 20, 2006, but he could not remember the exact time.

He said it was common practice for him to leave his pistol behind as he was earlier slated to go on escort assignment in Hong Kong, which was later cancelled.

Azilah told the court he went to Abdul Razak's house after 8.30pm on Oct 19, 2006, with Rohaniza, whom he was having buka puasa with, and Sirul came in later.

"I saw the Chinese woman (Altantuya) with Bala (private investigator P. Balasubramaniam) outside Abdul Razak's house. I went there to try and advise Altantuya to stop threatening and harrassing Abdul Razak," he said.

The chief inspector however disagreed that he had called the political analyst about 9pm to say "malam ini anda boleh tidur lena" (tonight you can sleep soundly) and that he had told Bala that he would take the Mongolian woman with him.

Called Sirul on the cell phone

Azilah said he drove a Proton Wira while Rohaniza was seated with Altantuya at the back, while Sirul Azhar was in front of him driving his jeep.

Asked by Tun Majid how he knew Sirul was driving a jeep, Azilah said he had seen Sirul driving it while going hunting in the forest.

The accused said while Sirul was in front of him, he would at times call his friend on the cell phone but he said he could not remember the corporal's phone number.

He added they later went to Bukit Aman and stopped at the Special Action Squad officer's quarters where he asked Altantuya to ride with Sirul who would bring her to her hotel.

Tun Majid: I put it to you that you were with Altantuya in the jeep with Sirul?

Azilah: I disagree.

Tun Majid: Did you contact Sirul Azhar the next day or the coming days to ask what happened to Altantuya?

Azilah: No.

Tun Majid: Hence, you thought Abdul Razak's problem had been resolved that night?

Azilah: Yes, I thought the matter had been settled the same night.

Tun Majid: I put it to you that Abdul Razak's problems had been settled because you and Sirul had shot her and used explosives on her at Puncak Alam.

Azilah: I do not agree.

abdul razak bagindaTun Majid: At 9.41pm, you telephoned Abdul Razak (pic) where you said the deceased was with you in Bukit Aman? However, at the time you were actually with Sirul and Altantuya heading towards the Jalan Duta toll plaza?

Azilah: No, I did not tell Razak anything and at that time I was in Bukit Aman and not at the Jalan Duta toll. (Note: Azilah's phone records indicated he was at the Jalan Duta toll plaza).

Tun Majid: At about 9.57pm, you made a call to the chief escort of the deputy prime minister, one assistant superintendent Hazani. This time you, Sirul and Altantuya were at the North Klang Valley Expressway (NKVE) at the Kota Damansara exit.

Eating at mamak shop with fiancee

Azilah: Yes, I did make a call to Hazani asking about my duty tomorrow as Hazani was at the TUDM airport in Subang escorting the deputy prime minister after returning from Pekan, Pahang. However, I was not at Kota Damansara but at Bukit Aman. (Azilah's phone records indicate he was at NKVE The Rock.)

Tun Majid: I put it to you that between 9.41pm till 11.52pm you were not at Bukit Aman, but you were with Sirul Azhar and Altantuya, heading towards Puncak Alam?

Azilah: I do not agree.

Mohd Zaki (Judge): Are you sure that within the two hours and 10 minutes you were not there (in Puncak Alam)?

Azilah: I was at Bukit Aman.

Tun Majid: What time were you with your fiancee Norazila?

Azilah: 10.30pm onwards, and I was having char kuey teow with her at a mamak shop near Carrefour in Wangsa Maju.

Tun Majid: Did you make a phone call or receive a phone call from Rohaniza close to 10.43pm and again at 11.28pm? Were you at Puncak Alam

Azilah: I could not remember the time but at that time I was with my fiancee in Wangsa Maju.

Tun Majid: I put it to you that you were with Sirul in the mission to kill and destroy or explode Altantuya?

Azilah: I do not agree.

Mohd Zaki (Judge): Are you sure you were not there (in Puncak Alam) within the said 45 minutes? Did you not kill and explode the victim?

Azilah: That is correct. (Phone records indicate Azilah was at Puncak Alam.)

Hearing continues tomorrow.
