The interim injunction obtained by property developer Perspektif Masa Sdn Bhd has no provisions for the demolition of houses in Kampung Berembang, Ampang.

According to the settlers' lawyer Teng Chang Khim, this morning's demolition exercise went against the law.

"It is an abuse of power to intentionally misinterpret something that is not provided for in this injunction in order to fulfil the aims of the developers," added Teng, who is also Sungai Pinang assemblyperson.

The court order for the interim injunction obtained on Feb 27 stops anyone from disturbing or threatening the plaintiff (Perspective Masa) in the execution of its housing project.

Perspektif Masa is the developer appointed by state-owned Permodalan Nasional Selangor Berhad, who owns the land.

Perspektif Masa is a subsidiary of property developer Acmar International, a private company which has entered into joint ventures with PNSB.

Today, the last four makeshift houses in the area were reduced to rubbles after the police forcefully evicted its occupants.

'Done in bad faith'

Another lawyer who was also present, Edmund Bon, explained that Perspektif Masa filed a suit on Feb 7 seeking full rights to develop the land where the Kampung Berembang settlement once stood.

The case is scheduled to be heard on May 23.

But on Feb 27, the plaintiff obtained the ex-parte injunction in chambers. Kampung Berembang settlers are expected to attempt to have the injunction set aside during the inter-parte hearing on March 14.

"Why can't they (developers) just wait for the hearing? By demolishing the remaining houses, they are destroying the subject matter of the suit.

"They are rending their own suit academic. This shows that this was done in bad faith," said Bon.

Up to this morning, several families had remained in the former settlement. Some had refused the state's housing scheme while others claim they were not given any alternative housing at all.
