Since the dissolution of Parliament and State Assemblies, elected reps no longer exist. The caretaker Government is only there to ensure the continuity and smooth running of government machinery and nothing more, full stop. In the eyes of EC, all those vying for seats are only candidates in the GE. Caretaker Government is only meant for administrative purposes and has nothing to do with the General Election. The special treatment for top Caretaker Government Officials by the EC should be deemed ultra vires, what say you, the Constitutional Law experts?

Who deoes EC chief Hashim think he is – an ancient emperor who can decree as he likes? That political contestants in an election can be pushed around like a bunch of kindergarten kids? Anyone fool can see that Hashim is acting like a henchman for his political master to tie and gag his master’s opponent in the impending electoral fight. Limiting the display of only Wan Azizah and Azmin and the candidate’s photos (that is what EC’s new rules about) and banning all other photos for all Pakatan Harapan candidates is to force Pakatan Harapan to falsify its challenge as PKR vs BN, while in truth, it is Harapan vs BN. Such a grotesque ruling is not only a monstrous injustice to Harapan but also a grand deception against the entire Malaysian electorate. Hashim has cited Section 4A of the Election Offences Act 1954 to justify his new rules. It is clear that the intent of Section 4A is to prevent inciting racial and religious conflict to win votes. But how could the graphic presentation of Harapan’s leadership be even remotely considered as causing racial and religious strife? If it can’t, why must EC ban it? In fact, shouldn’t EC, as a good umpire, have encouraged it so as to give the electorate a clearer picture of the real choice before them? Hashim would be well advised to withdraw his silly ruling, before further damage is inflicted on the public image of EC and the already much discredited Malaysian electoral system.

Looking at the details of what can be and cannot be done, it is clearly a tailor-made set of rules to facilitate the incumbent and tie both the hands and legs of its opponents. Clearly and practically there will be 0% additional restriction imposed on the incumbent, whereas its opponents being not officially registered and recognised by EC, none of the pictures of symbolic figures, leaders, and logos of component parties can be displayed thus minimises or even to a large extent wipe out the influences and goodwill of these vital contents.

EC - making up stuff as you go along. The only item of relevance is the first item regarding permits etc as allowed under the Electoral Act. All the rest are just fairy tales. To my mind, just ignore the rest as they have no basis under the Act. Will be good to review the functioning of the EC after PKR wins the election.
