The Kuala Lumpur High Court today ordered former military pathologist Dr R Kunasegaran and five others, who have been charged with murdering deputy public prosecutor Anthony Kevin Morais, to enter their defence.

Justice Azman Abdullah said the prosecution has proven a prima facie case against the six.

Initially, Kunasegaran (photo), who was with the Tuanku Mizan Military Hospital in Kuala Lumpur, was charged with abetting the murder. However, the prosecution amended the charge on May 15.

R Dinishwaran, 25, AK Thinesh Kumar, 24, M Vishwanath, 27, S Nimalan, 24, and S Ravi Chandaran, 46 and Kunasegaran, 53, have claimed trial to murdering Kevin Morais along Jalan Dutamas Raya Sentul to No. 1 Jalan USJ1/6D, Subang Jaya between 7am and 8pm on Sept 4, 2015.

On July 27, Kunasegaran was acquitted by the Sessions Court in Shah Alam on six counts of using Tuanku Mizan Military Hospital's equipment without the knowledge of the hospital.

Kevin Morais' brother Richard, who was present in court, received a warning from the police after he started clapping when the verdict was announced.

Speaking to reporters later, Richard expressed happiness with the decision and commended the police on their “terrific work” with regard to the case.

Lawyer Simon Sabapathy, who holds a watching brief for Richard, described the court's decision as a victory for justice and Kevin.

"Justice has been done. Kevin will get a proper justice he deserves,' he said.

A total of 70 prosecution witnesses testified in the more than 50 days of trial.

Kunasegaran was represented by lawyers N Sivananthan and Jay Moy Wi Jiun, while lawyers M Manoharan and Chua Li Li appeared for Dinishwaran and Thinesh Kumar. Nimalan and Ravi Chandran were represented by V Rajehgopal and S Shiva Kumar.

Deputy public prosecutors Saiful Edris Zainuddin and Wan Shaharuddin Wan Ladin appeared for the prosecution.

In Dec last year, G Gunasekaran, who was the second accused, was sentenced to two years in jail after pleading guilty to disposing of evidence in the case.

The High Court has fixed Jan 18, 19, 25 and 26, and Feb 22 and 23 for the hearing of the defence.

Kevin's body was found in a cement-filled steel drum.
