The Election Commission has breached the Federal Constitution for going ahead with the redelineation exercise without Selangor, said Serdang MP Ong Kian Ming.

Ong was commenting on EC's announcement on the commencement of the second round of public display for the 2016 redelineation exercise.

The notice does not include Selangor as the state government is challenging the redelineation exercise at the High Court.

Ong pointed out that Article 113 (6) of the Federal Constitution said the redelineation exercise is for the "states of Malaya and for each states of Sabah and Sarawak".

"This move is also highly questionable and very likely, unconstitutional...

"(Redelineation) for the states of Malaya cannot be presented in Parliament without the inclusion of Selangor," Ong said in a statement.

He said the move also puts in question the EC's independence, as it shows it is trying to rush the redelineation process.

This goes against precedent, which dictates that the EC should wait for the High Court's decision before taking the next step, he said.

"In the event that the High Court rules in favour of the Selangor state government, the EC cannot proceed with the public inquiry in Selangor.

"The EC would instead be forced to appeal the decision in the Court of Appeal and perhaps all the way to the Federal Court in order to seek a favorable ruling.

"This would delay the EC from presenting the completed delimitation exercise for Peninsular Malaysia to the prime minister for parliamentary approval," said Ong, who was once a researcher on the integrity of the voter registry.
