Independent preacher Wan Ji Wan Hussin has applied to take his sedition charge up to High Court as it concerns the constitutionality of the Sedition Act 1948.
 
Earlier, Wan Ji pleaded not guilty to a charge of sedition related to his Facebook posting in 2012 that allegedly insults the Selangor sultan.

Representing the 32-year-old preacher today were lawyers Lathefah Koya, N Surendran and Mohd Afiq.

"We want the case heard at the High Court as it is a constitutional matter.

“The Sedition Act is unconstitutional, so we argue it is not legitimate as it goes against the federal constitution," Surendran told the media today.

The decision whether to move it out of Shah Alam Sessions Court will be heard on January 16.

Wan Ji is one of 17 charged in a sedition dragnet last year that included opposition politicians, students and academic Azmi Sharom.

The PAS ustaz was arrested at Bandar Baru Sungai Buloh last Sept.

Last December, Surendran, who is also facing sedition charges for comments made on his client Anwar Ibrahim's sodomy case, suceeded in having his own proceedings stayed pending a constitutional challenge at the High Court on the same issues.
