'Inappropriate for PKA to talk about withdrawal now'

Port Klang Authority (PKA) today said its RM720 million land suit against Kuala Dimensi Sdn Bhd (KDSB) is still pending at the Shah Alam High Court.

Its lawyer Lim Chee Wee (left), said it is inappropriate now for PKA to make any statements about (the withdrawal of) the land suit until after the respective counsel of the parties appear before the High Court judge on Dec 2.
He acknowledged that PKA has recently received queries from the press regarding the purported withdrawal of its suits against KDSB.
"The evidence produced before - and findings of fact made by the High Court judge in the criminal trial against Transport Minister Dr Ling Liong Sik, who was acquitted of three charges of cheating the Federal Government regarding the Port Klang Free Zone (PKFZ) land deal - have a material impact on the civil suit brought by PKA against KDSB for recovery of interest paid on the purchase price of the land bought by PKA from KDSB," acknowledged Lim in a statement.
It is reported in The Edge Financial Daily today that PKA board had unanimously made the decision to withdraw its suit against KDSB during a special meeting in Putrajaya last Friday.
The suit was filed by PKA against KDSB, to seek rectification of the agreement signed on Nov 12, 2002, for the land worth RM1.88 billion.
This suit is the largest of four suits filed by PKA in relation to the RM12.5 billion PKFZ scandal.
The Edge reported that they had written to the attorney general and the Transport Ministry for advice but both entities did not want to make a stand, and they said PKA will have to decide on the matter.
Ling (right), who was transport minister was acquitted by the KL High Court on Oct 25 on three counts of cheating the government under Dr Mahathir Mohamad, in the multi-billion ringgit project. The AG Chambers did not file an appeal over the acquittal.
His successor, and former MCA deputy president, Chan Kong Choy also walked free from three charges of cheating then premier Abdullah Ahmad Badawi, after the prosecution withdrew the charges against Chan earlier this year.
Serdang MP Ong Kian Ming has criticised the possible decision to drop the suit as shocking.
