The Royal Malaysian Customs Department has been rapped for not taking action against agents who repeatedly committed offences.

According to the Auditor-General's Report 2013, one agent was found to have made nearly 500 mistakes during a period of three years.

The agent was compounded 468 times. Two other agents were compounded for 241 and 307 times respectively.



The mistakes were committed between the years 2011 and 2013.

The three Customs agents who were compounded by the Selangor Royal Customs Department had either violated Section 133 of the 1967 Customs Act for making incorrect declarations or Section 138 for other offences.

However, the Customs Department did not issue show-cause letters to the agents in order for disciplinary action to be taken against them.

No action against inactive agents

Howeve, the Auditor-General’s Report noted that the Customs Department finally issued show-cause letters to the three agents on Aug 7, 2014.

The report also stated that the Customs Department did not take action against 17 agents who were not active for more than a year.

“The state Customs director has to give a written notice and consequently revoke the licences of Customs agents who had not been active for more than a year,” said the report.

The agents were from the states of Penang, Sarawak and Sabah. Three agents from Sarawak were not active for more than 10 years, with licences having expired in 2003.

The Customs Department in the three states in feedback received on Sept 29, 2014, claimed that necessary action had been taken, by either revoking the agents’ licences or suspending them.
