Hindu mother S Deepa has yet to file any contempt proceeding against her former husband, Muslim convert Izwan Abdullah, after Izwan snatched away their six-year-old son from her home in Jelebu, Negri Sembilan, on April 9.

Women’s Aid Organisation (WAO) advocacy officer Sally Wangsawijaya told Malaysiakini that discussions with Deepa’s lawyers on the next course of action were still going on.

Deepa, 30, who is currently in hiding in order to prevent her ex-husband from taking away the couple’s nine-year-old daughter as well, intends to pursue a contempt of court proceeding against Izwan and also apply to have the two children’s unilateral conversion to Islam by the father revoked.

The High Court had on April 7 granted Deepa custody of both the children, who were converted to Islam by Izwan in 2013 without Deepa’s knowledge, shortly after he converted to Islam.

However, Izwan took away the son two days later, injuring Deepa in a scuffle. He later claimed that he did so to protect his son from being turned against Islam by the mother.

Last year, he was granted custody of the two children by the syariah court.

“Deepa and we are in discussion with the lawyers on the next legal course to be taken,” Sally said.

The police have refused to take any action on the kidnap of Deepa's son, pointing to the two different custody orders, from the syariah court and the High Court.

However, the police indicated, they will probe Izwan, who now works for an Islamic NGO, for his alleged assault of Deepa.
