The Kuala Lumpur High Court has today dismissed a RM5 million defamation suit brought by the Kemaman Municipal Council (MPK) against PAS.

Justice Rosilah Yop ruled that the municipal council had failed to prove elements needed in a defamation suit following the publication of a pamphlet titled “Fakta Zoo Bukit Takal” (Facts on the Bukit Takal Zoo).

“The plaintiff also failed to prove the defendant was involved in the publication and the distribution of the article,” she ruled.

The Kuala Lumpur High Court has also ordered MPK to pay RM30,000 in legal costs to PAS.

It was reported that MPK obtained a judgment in default in May 20, 2013, against PAS in their RM5 million suit after the Islamist party failed to appear in proceedings.

However, PAS managed to set aside the order in July.

MPK filed the suit on March 22 last year against PAS, which it claimed had distributed pamphlets containing false and defamatory words on the Bukit Takal Zoo.

PAS was represented by lawyer Noorazmir Zakaria (above), who is also PAS Youth director of the Legal and Human rights division.
