Pakatan's bid to nullify GE13 results dismissed

The Kuala Lumpur High Court has dismissed Pakatan Rakyat’s bid to nullify the 13th general election results on the basis that the failures of the indelible ink allowed for cheating.

Judge Rosnaini Saub accepted the Election Commission’s (EC) preliminary objections and ordered the eight plaintiffs to pay RM10,000 in costs to the commission.
She said that elections can only be nullified in an Election Court and not a Civil Court, and it is also unfair that none of those who won in the election were named as parties to the hearing.
On the plaintiff’s demand to sack all EC commissioners for bias, she said commissioners can only be removed by a special tribunal and the court has no jurisdiction on this.
Speaking to reporters later, former Kuala Selangor MP Dzulkefly Ahmad (second from right in photo), who is one of the plaintiffs, said the plaintiffs are “inclined” to appeal the case.
He said a full trial is needed for systemic issues in the election to be brought out and addressed, but striking out the case on technical grounds thwarted this.
“The question involves constitutional issues. Where do we go, if not the High Court? I am not sure whether the Election Court has the authority to deal with constitutional issues alone. I think this has to be tested,” added another plaintiff, M Manogaran.
Other plaintiffs in the case are PKR, DAP, PAS, Kulim-Bandar Baharu PKR candidate Saifuddin Nasution, and voters Arifin Rahman and R Rajoo.
