YOURSAY ‘So because you’re Muslim and bumi you cannot be terminated?’

We are not animals, cry former PKNS staff

Don't PlayPlay: Speaking as a person who regularly hires and fires contract workers, I can tell you that it is 100 percent legal to terminate the contract midway, provided the termination is done within the provisos of the signed contract.

I am inclined to believe PKNS (Perbadanan Kemajuan Negeri Selangor) has studied the terms before deciding to terminate the services of these people. These workers have the option to go to the Labour Department to challenge PKNS' dismissal if they have good grounds.

When one accepts an employment based on a fixed contract period, he/she must be prepared mentally to have no employment at the end of the period.

Provided these people are adequately compensated, they have no right to complain. After all, they signed the offer letter which clearly stipulated that it is a fixed-period contract employment.

Unless you were thinking that Umno will take care of you. Then, do proceed to Putrajaya to look for Prime Minister Najib Abdul Razak.

MinahBulat: PKNS Holdings former marketing division head Dr Aliff Aiman, what do you not understand in your contract?

You are contract staff employed under terms. In the corporate restructuring exercise, PKNS discovered that they no longer need your services. What have you being a Muslim got to do with it?

You are being laid off not on account of any breaches but that your services are no longer required. Are you suggesting that because you are a Muslim and a bumiputera you cannot be terminated? What rubbish.

Single Malt: Before one accuses, ensure whether the PKNS Holdings management has deliberately flouted their contract agreement. If yes, take them to the Industrial Court and get compensation for the sacked workers. That's the law.

Anonymous #06188481: Aliff said, “We are humans, what’s more we are all Muslims. Even non-Muslim companies would not do this."

He is bringing religion into play here, trying to whip up negative feelings of other Muslims against Pakatan Rakyat state government.

This sacking has got nothing to do with religion and race. It has perhaps everything to do with redundancy, not making the mark, being a mole for Umno, or even going against the philosophy and work ethics of PKNS.

Hplooi: This shows the level of 'stratification' this country has come to. Some citizens think the state owes them a living.

In the private sector, a contract worker "let off" would take this as a fact of life and move on. The scary thing is I have met people in the private sector who would run to their nearest Umno branch when their employment contract was terminated.

In the private sector, asking a contract staff to leave with 24 hours notice (provided adequate compensation is satisfied in accordance with the contract) would be the standard practice, particularly if security is a major concern with the released staff in question.

Can you imagine giving one-month notice to a staff who you may suspect to be a security risk? Imagine the damage he can do even in one day in office before packing up?

I've been there, done that. I am only puzzled as to why Malaysian Trades Union Congress (MTUC) is getting mixed up in this mess.

Retired Citizen: It is fully justified to terminate the service of redundant contract staff. However, terminating their service so suddenly without preparing them for such an event is inhuman except in disciplinary cases.

Even if no law or agreement is broken, the management is morally obligated to inform them in advance.

Thana55: Well, there must be more to this story. It’s very possible that some of these contract staff were undermining Selangor MB Abdul Khalid Ibrahim's government.

Oh Ya?: PKR has a lot of explanations to do if there is any truth in the allegations that these people were appointed by their PKR political masters to serve their interests but paid by PKNS. The voters did not vote for an Umno clone.

Maplesyrup: Yes, I suspect some of these so called 'contract workers' are nominees of politicians who are engaged to give them an income.

Anyway, contract employees are usually paid a bit better than the normal employees, compensating for other less favourable terms. Job security is certainly not something that a contract worker can expect or demand.

Telestai!: Muslim or not, the company is duty bound to act in accordance with the terms of the employment contract. So long as the employees have been given their dues, don't expect any charity.

Please don't bring in religion or race into something that is quite routine. Get a grip, guys. Companies across the globe retrench employees every day.

This isn't Kunta Kinte country, MTUC tells PKNS

Ketuanan Rakyat: When did the Malaysian Trades Union Congress (MTUC) start representing five-figured contract employees?

Everything is turned into racial issue in Umnoputras’ 1Malaysia with unlimited possibilities. Don't be surprised, Umnoputras agents may say DAP is behind these dismissals.

Let us look at it fairly. These people are employed under contract at much higher salary than normal staff in PKNS. Their contract can be terminated as per clauses in the contract. Don't turn this into a racial issue.

Anonymous_1390562550: I am sure there must be specific laws for the termination. If you are wronged, there is no need to shout on TV. Take them to the Industrial Court and demand your rights.

Longjaafar: I'm quite sure, PKNS had a look at the law before acting. If they did not, then there's only one word to describe this move - stupid.

Hplooi: It is about time the government, (including state governments and government-linked corporations) start to pare the excessive bloat in the service.

You probably start with contract workers unless the said contract workers can prove their weight in gold.
