Shafee hopes for decision over Anwar appeal on Feb 11

Lawyer Muhammad Shafee Abdullah said he hopes that the Federal Court would decide on Feb 11 itself on the second appeal by Anwar Ibrahim to disqualify him from leading the prosecution team seeking to set aside the opposition leader’s acquittal for sodomy.
This would enable the prosecution’s appeal to be heard on Feb 12 and 13.

He told reporters today that a decision on Feb 11 would enable the prosecution’s appeal against the acquittal to be heard on Feb 12 and 13, the dates set by the Court of Appeal.
Anwar, 66, was acquitted by the High Court on Jan 9 last year on a charge of sodomising his former aide, Mohd Saiful Bukhari Azlan, at a Desa Damansara condominium unit in Bukit Damansara in 2008.
The Federal Court had set Feb 11 to hear the second appeal by Anwar to disqualify Muhammad Shafee when the matter came up for case management last Tuesday.
Muhammad Shafee, a senior lawyer, was appointed by the attorney-general by fiat (authorisation) under Section 376 (3) of the Criminal Procedure Code (CPC) and Article 145 (3) of the federal constitution to conduct the appeal at the Court of Appeal.
On Dec 20 last year, the Court of Appeal’s three-member panel led by Justice Aziah Ali, unanimously dismissed the application and ruled that Muhammad Shafee’s appointment was within the law.
Anwar, 66, filed the second application to disqualify Muhammad Shafee from leading the prosecution team in its appeal against Anwar’s acquittal on a sodomy charge using information from the statutory declaration made by former Kuala Lumpur CID chief Mat Zain Ibrahim to support his application.
His first application was dismissed by the Court of Appeal on Sept 17 last year, following which he appealed to the Federal Court, but it was also dismissed.
