Duo charged over polling day incident in Klang

Two men were charged at the magistrate’s court in Klang today with wrongfully restraining and breaking the windows of a bus in Pandamaran on polling day, May 5.

Gew Chen Hsiang, 33, of Bandar Bukit Tinggi 2 and Chua Kian Boon, 21, from Pandamaran, pleaded not guilty to the charges.
Gew, a mobile phone salesman and four others still at large, allegedly restrained a Wawasan Sutera T&T Sdn Bhd bus with 23 passengers on board at Jalan Sijangkang, Pandamaran at about 3.45pm on May 5.
He was charged under Section 341 of the Penal Code which is punishable by up to one month in prison or a maximum RM1,000 fine or both, upon conviction.
Meanwhile, air-conditioner technician Chua and several others still at large were charged with using a rock to break the windows of the same bus during a riot at the same place, date and time.
He faces up to five years in prison or fine or both upon conviction under Section 148 of the Penal Code.
Magistrate Mohd Fathly Yaacob set bail at RM5,000 with one surety each and fixed June 7 and June 19 respectively for re-mention of both cases.
Earlier, lawyer V Murali, who represented Gew, appealed for a lesser bail, stating that his client had two young children and earned only between RM2,000 and RM3,000 per month.
Whereas Chua’s lawyer S Ramesh also applied for the same on the basis that his client had fully cooperated throughout the police investigation.
He further cited two other election offences cases in another magistrate’s court last Friday which had set lesser bails.
However, Mohd Fathly said despite the lower bails set in the cases last Friday, the court felt that it had to send a stern message to the society that such behaviour was unacceptable.
He added that the court viewed the charges seriously and therefore maintained bail at RM5,000 each.
Last Friday, Lim Siong Kuan, 32, and Yap Kwee Heng, 36, pleaded not guilty to being involved in a riot and breaking the windows of a City Liner Sdn Bhd bus with helmets and steel pipes at Jalan Mesra, Pandamaran on May 5.
Deputy public prosecutor Mahmoodah Abd Latiff appeared for the prosecution.
