Artistes association files bid to strike out suit

The Malaysian Artistes Association (Seniman) and seven others filed a High Court application to strike out the suit brought by several veteran artistes claiming its annual general meeting (AGM) was invalid.

On Jan 25, Abu Bakar Omar, Sahlan Sudiran, Mior Ahmat Zaudi Mior Ali, Abdullah Sani, Merriane Mohd Tap, Jamaliah Mohd Dahan, Azizah Ab Aziz and Roslinda Buang filed a suit against the association and seven others.
The plaintiffs named the association, its president at the time Haron Aminar Rashid Salim or Harun Salim Bachik, secretary Omar Kamarudin or Yusof Kelana, treasurers Wafa A Kadir and Rozaidi Abdul Jamil also known as Zed Zaidi, who was the then acting deputy president, as defendants.
Three others were committee members Elyas Ismail, Syed Ahmad Nahar Syed Mokhtar and Zaharudin Wahab.
The association filed an application yesterday to strike out the suit on the basis that the plaintiffs had insufficient quorum to obtain a declaration to declare the AGM null according to Article 13 of the artistes constitution.
Lawyer Wan Rohimi Wan Daud, who represented the plaintiffs during the case mention in chambers today before Judicial Commissioner Rosilah Yop, told reporters that case management was fixed for March 8.
The plaintiffs are seeking to declare the 14th Malaysian Artistes Association AGM, its 2011 Annual Financial Report and minutes tabled on May 26, 2012 as null and void.
They claimed that this was due to there being hundreds of individuals present at the meeting whose memberships were doubtful.
They are seeking general and exemplary damages and other relief deemed fit by the court and for Harun Salim Bachik, Yusof Kelana and Wafa to pay RM56,000 to the association for alleged losses incurred in a land transaction.
