Cop probed for culpable homicide over teen's death

Police has started an investigation on the death of a teenager after the motorcycle he was riding was allegedly kicked by a policeman on Dec 25 of last year, under Section 304A of Penal Code for culpable homicide not amounting to murder.
Mohd Azrul Zulkifli’s family has urged the police to carry out a more professional and transparent investigation into his death.
Police has started an investigation on the death of a teenager after the motorcycle he was riding was allegedly kicked by a policeman on Dec 25 of last year, under Section 304A of Penal Code for culpable homicide not amounting to murder.
Petaling Jaya OCPD Arjunaidi Mohamad told Malaysiakini today that the policeman alleged to be involved in the case is still discharging his duty in a police station in the district.
“I cannot give any information yet on the investigation. We need to investigate first,” he said when contacted, declining to state how long the probe will take.
He was asked about the case after the father and a friend of the teenager gave their statements to the police yesterday morning.
They were Zulkifli Hashim, 49, the father of 19-year-old deceased Mohd Azrul Zulkifli (left), and Khairul Azrisham Abu Kassim, 22, who was the pillion rider on the motorcycle.
Their lawyer Mohd Yusmadi Yusuf, who is also PKR Balik Pulau MP, claimed he was told by investigating officer ASP Lim Chee Koon that the case is being investigated under Section 304A of Penal Code for culpable homicide not amounting to murder.
“I was also informed that it is related to a criminal investigation, different from the preliminary investigation when we first came here on Dec 31, which was (then being investigated) under traffic offence,” he said.
Yusmadi said the duo was summoned by the police to have their statements recorded after they lodged police reports on the day of the incident.
In his police report, Khairul claimed that a man riding a motorcycle stopped the motorcycle rode by Mohd Azrul and him, and requested them to stop while they were passing by Sri Manja, Petaling Jaya early morning that day.
Out of fear that the man would hurt them, the duo did not stop.
The man suddenly approached them from back and kicked twice on the rear side of their motorcycle causing it to skid and hit the road divider on the right side of the road, Khairul claimed.
“When I realised (what has happened), the man introduced himself as a policeman and asked why I did not stop. I told him that he did not introduced himself as a policeman when he stopped me,” read the police report.
Khairul suffered injuries on his eyes, face and arms while Mohd Azrul injured his head and went unconscious.
According to media reports, Mohd Azrul passed away the next day in the Universiti Malaya Medical Center.
Slander against the police?
Malay daily Harian Metro quoted Petaling Jaya deputy OCPD Tuah Masrom on Friday as saying that the allegation that claimed the policeman had kicked the motorcycle is “slander with the intention to tarnish the image of security force”.
Tuah reportedly said that investigations found that the Mohd Azrul’s motorcycle skidded by itself after the teenager lost control and hit a tree.
The argument was rebutted by Yusmadi who said the police should not draw conclusions before the investigation is complete.
Mohd Azrul’s family, said Yusmadi, urged the police to carry out a more professional and transparent investigation, and has instructed him to take legal action including civil suits when necessary.
