The Malaysian Anti-Corruption Commission's (MACC) investigations into private investigator (PI) P Balasubramaniam's matter have been completed, but the file will be re-opened if there are new leads.

This was the response from MACC deputy chief commissioner Mohd Shukri Abdull when asked about the revelation by carpet dealer Deepak Jaikishian in an interview with Malaysiakini last week.

NONE Deepak in the interview admitted to having a role in Balasubramaniam ( right ) making his second statutory declaration (SD).

However, the businessperson said, he regretted taking part in the affair that saw PI Bala reversing his earlier SD which linked Prime Minister Najib Abdul Razak to murdered Mongolian national Altantuya Shaariibuu.

Shukri told Malaysiakini that the MACC investigation into Bala's allegations had been completed.

“The file has been submitted to the deputy public prosecutor (DPP) for a decision. Based on the facts and evidence, the DPP decided that no further investigative actions need be pursued.

“The case had also been presented to its (MACC’s) operations review panel, which agreed with the DPP's decision.

“In accordance with established practice, the MACC is prepared to re-open the case if there is any new and relevant information and evidence received," Shukri responded by SMS.

The operations review panel is headed by former auditor-general Hadenan Abdul Jalil and the DPP's office by MACC's head of prosecution Abdul Razak Musa, who is seconded from the Attorney-General’s Chambers.

The MACC itself comes under the Prime Minister's Department.

No reply on Deepak's disclosure

NONE Asked whether the disclosure by Deepak ( left )  constituted new and relevant information, Shukri did not give any reply.

Shukri's disclosure affirms what Balasubramaniam's lawyer Americk Sidhu disclosed last month - that there was insufficient evidence for it to act on Balasubramaniam's claim.

“The deputy public prosecutor has examined the totality of the evidence but finds that there was lack of evidence to charge any person with any criminal offence,” Americk had said, referring to the reply from the MACC.

Deepak said in the interview that he was roped in at the request of a "female friend" associated with the parties who would be affected by the fallout from Bala's first statutory declaration .

“I was asked to help by a friend, I agreed to help her because I could see the repercussions will affect their entire group. It was to me - getting involved in this whole Bala fiasco - a mistake," the Deepak said.

azlan Deepak is known to be closely linked to Prime Minister Najib Abdul Razak's wife Rosmah Mansor.

It was also reported that the second SD had helped foil a planned confession on the  murder being organised by politicians from both sides of the divide, including Opposition Leader Anwar Ibrahim.

Balasubramaniam, on commenting Deepak's disclosure, said he had felt vindicated by the businessman's expression of regret.
