High Court judge Arifin Jaka this morning ordered the defence team of Anwar Ibrahim to immediately serve the sacked deputy prime minister's affidavit on Prime Minister Mahathir Mohamad.

The affidavit states the reasons why Mahathir should appear in court to testify as a witness in Anwar's sodomy trial. Arifin said his order is to "be fair" to Mahathir and give the prime minister until 4pm on Tuesday to raise objections.

The trial is subsequently postponed to Monday.

Arifin ordered counsel Sankara Nair to personally serve the affidavit on Mahathir. The judge also gave immunity to Nair against prosecution and other actions which may arise in the event.

Nair said he will serve the notice to the premier by 4pm this afternoon in Putrajaya.

Meanwhile, Anwar has filed this week affidavits to counter motions by two prominent politicians to set-aside the subpoenas served on them to testify at Anwar's sex trial.

Finance Minister Daim Zainuddin and deputy Education Minister Aziz Shamsuddin who is also Mahathir's former political secretary filed the motions last week stating they are in no position to give relevant and material evidence at the trial.

Anwar, in his affidavit, alleges the corruption and sex charges framed against him are "unfounded, vexatious and nothing but a political conspiracy hatched by certain people including Daim and Aziz" to topple him from power.

"The political conspiracy would entail and encompass the designing and hatching of an elaborate scheme of fabricating, creating and manufacturing false and scandalous evidence of sexual misconduct and sodomy against me by employing and funding various persons," Anwar said.

Anwar said Daim and Aziz were also in contact with two star witnesses, Ummi Hafilda Ali and Azizan Abu Bakar, in the trial.

His affidavit points out that Azizan told the court Aziz forced him to make false admissions that Anwar forced sex on the ex-driver. It also states Ummi met Daim before writing letters to Mahathir alleging Azizan was repeatedly sodomised by Anwar.

"Daim met me on another occasion in my official residence and explained to me what transpired in the meeting with Ummi and then advised me to ignore such malicious and scurrilous allegations," Anwar said.

Anwar also said that former Special Branch (SB) director Syed Awang and his deputy Amir Junus reported Aziz was involved in planning and orchestrating the scheme (to topple Anwar from power) with Ummi and Azizan.

"They also reported about Daim's schemes to vilify and defame me because he considered me a serious threat to the continued preservation of his ill-gotten wealth and perpetuity of his enormous business empire."

Anwar's affidavit pleads that his counsel had adduced evidence through different witnesses that Aziz also harboured hatred against him and had alleged Anwar was a foreign agent who has accepted billions of ringgit from the CIA.

In concluding his affidavits, Anwar said he verily believes that evidence from Daim and Aziz is crucial as they were involved in the "despicable conspiracy" to defame him and topple him from power using Azizan and his former political secretary Azmin Ali's sister Ummi.

"They were instrumental in the conspiracy approved by Dr Mahathir who has full control of the apparatus of the state."

Ng Aik Guan, counsel for both Aziz and Daim, said he would submit his arguments against the affidavits filed by Anwar on Tuesday as he "needs more time to get instructions from clients".

Anwar, who is serving a six-year jail term for corruption, stands trial for a separate charge of sodomy and sexual misconduct. The one-time heir apparent of Mahathir has repeatedly denied all charges and says they were trumped up to end his political career.
