Judge Ahmad Zamzani Mohd Zain fixed Dec 10 for P Uthayakumar’s defence trial after ruling that the prosecution, represented by deputy public prosecutor Noorin Badarudin, had succeeded in establishing a prima facie case against the accused.
Counsel M Manoharan told the court that Uthayakumar, 50, would be testifying under oath.
Uthayakumar claimed trial on Dec 17, 2007, to publishing the letter on the website between Nov 15 and Dec 8, 2008.
If convicted, he faces a fine of not more than RM5,000 or a jail term of up to three years, or both, under Section 4(1)(c) of the Sedition Act.
