Save Malaysia Stop Lynas (SMSL) will apply to Kuantan High Court to have Lynas’ temporary operating licence (TOL) suspended pending the completion of two judicial review cases against the rare earth plant in Gebeng.

“A responsible government would never have issued the TOL knowing full well that the court has accepted SMSL’s two judicial review applications.

NONE “Furthermore, neither the Atomic Energy Licensing Board (AELB) nor the Ministry of Science, Technology and Innovation (Mosti) has responded to SMSL’s legal letter requesting for the TOL to be suspended by the due date of Sept 10,” said SMSL spokesperson Tan Bun Teet ( left ) in a statement today.

The application will be made tomorrow before the Kuantan High Court in Bandar Indera Mahkota Court Complex.

“Tomorrow will be a good test of our judicial system in delivering justice. We wait in hope that the truth shall prevail and that justice will be dealt,” said Tan.

occupy balok gebeng anti lynas 230612 4 On Aug 28 Kuantan High Court judge Justice Mariana Yahya granted SMSL leave to proceed with their judicial reviews against the TOL.

One of the judicial review applications is to revoke the TOL on the grounds that no detailed environmental impact assessment (DEIA) had been performed and a radiological impact assessment and waste management plan had not been submitted prior to the TOL’s approval.

The other seeks to review the Mosti minister’s decision not to revoke the TOL following an application by a group of Kuantan residents.

“Lynas has not found a solution for its waste. We are concerned with the risks of air and water pollution on top of it.  

“Why should the TOL be issued under such uncertainties and risky situation?” asked Ismail Abu Bakar, a Kuantan resident and applicant in the second judicial review application.

'Boycott Lynas'

Meanwhile another anti-Lynas group Stop Lynas Coalition (SLC) said they were also making an appeal to the Federal Court in a related matter latest by September, as well as sending an appeal today to Mosti to have the Lynas TOL revoked.

NONE They added that they are embarking on a nationwide campaign to boycott Lynas Corporation.

“We will write the letter of appeal to house-owners, housing agents, transport operators and service providers not to engage in any business transactions with Lynas Corporation. 

“We appeal to all Malaysians with a conscience to boycott all Australian products,” said SLC spokesperson Andansura Rabu in a statement today.
