The Kuala Lumpur High Court yesterday allowed a judicial review request by five Kolej Universiti Insaniyah (Kuin) students of their college suspension on May 26, 2011.

In a statement issued late yesterday, the students' lawyer Mohamed Hanipa Maidin said that Justice Abang Iskandar Abang Hashim found  Kuin's disciplinary committee's ruling on the students "null and void".

"The judge said that this is because...the (college) disciplinary regulations used to try the students is ultra vires Section 46(1) of the the Private Higher Educational Institutions Act 1996 and Article 11(2) of Kuin's constitution," he said.

The judge also found the college disciplinary regulations ultra vires eight other subsections of the Private Higher Educational Institutions Act 1996.

NONEThe students were suspended for participating in a demonstration, giving a public speech and for issuing a press statement.

All members of the student representative council,they opposed the use of one of the college's building to house a private school, Sekolah Insan Bestari.

Mohd Faiz Mohd Arshad was suspended for two semesters; Mohd Aiman Che Ab Razak, Zukhilatif Marzukhi, Mohd Azlan Mat Zain and Ahmad Remi Md Arof for a semester with a warning.

Mohamad Farhan Mohamad Baharin was issued a warning letter and fined RM100.

The suspension stirred up controversy, as the PAS-led Kedah government-owned college had invoked a law which was similar to the University and University Colleges Act opposed by Pakatan Rakyat.

The students were represented in court yesterday by Azhana bin Mohd Khairudin from Mohamed Hanipa and Associates while Kuin's counsel was Karpal Singh, who is also DAP chairperson.
