The Kuala Lumpur High Court today struck out a RM218-million suit by an election material supplier against BN secretary-general Tengku Adnan Tengku Mansor and two others.

Justice Mohamad Ariff Md Yusof also ordered the supplier Elegant Advisory Sdn Bhd to pay RM1,500 costs to Tengku Adnan and the other defendants, BN treasurer-general Ahmad Husni Mohamad Hanadzlah and a BN public officer.

kuala berang by-election 260804 elegant advisory closeup 01Counsel Mohd Hafarizam Harun, who represented all three defendants, told reporters that Mohamad Ariff, who made the judgement in chambers, did not consider other costs as the action was filed after six years.

The judge also held that the plaintiff had abused the court process by filing two other suits in connection with the same items and products.

Elegant Advisory filed the suit on Feb 17 this year after an earlier action it filed in 2009 was rejected when Umno succeeded in setting it aside on grounds that the plaintiff did not abide by the Contracts Act 1950.

Elegant Advisory had, in its writ of summons, claimed to have supplied election material, transportation as well as publications, and provided BN with various election paraphernalia it needed during the 11th general election in 2004.

The company had also claimed that it sent an invoice of RM218,013,475 to the defendants, and said they had failed to pay up. 

Later, a lawyer representing Elegant Advisory indicated that their client has directed them to file an appeal at the Court of Appeal over today’s decision.
