Najib, Rosmah bid to set aside subpoena

I don't need to hide behind the thick wall of the Prime Minister's Office or shamelessly hide under the guise of Allah for my defence in a mosque as no one the better will know of my devious ways except for Allah only on my demise when I face him on Judgement Day.

Pemerhati: If PM Najib Razak refuses to defend himself against Anwar Ibrahim's accusations that were made in his statement in court, then we have to assume the accusations are true.

Some of his accusations are, "This entire process is nothing but a conspiracy by ... Najib ... to send me into political oblivion by attempting once again to put me behind bars... I have no faith whatsoever that justice will prevail in these proceedings...

"This is not a criminal trial. It is a charade... Najib Razak is doing the same thing as his mentor did, which is to employ ... the media, the police, the attorney-general and the judiciary in order to subvert the course of justice ... the prime minister himself and his wife, Rosmah Mansor, both of whom by the complainant's own admission had met him in their residence where he purportedly complained of being sexually assaulted.

"The initial statement by Najib that he had met with the complainant merely to discuss about a scholarship was a blatant lie only to be retracted later...".

Changeagent: What compelling reason is there for Najib and Rosmah to set aside the subpoenas?

Isn't this the same couple who initially denied, then reluctantly admitted to meeting Saiful on the June 24, 2008 at their own residence, coincidentally two days before the alleged sodomy took place?

If they had no involvement in planning this whole debacle, they should come to court to clear the air.

Keturunan Malaysia: Najib has the public duty to defend his innocence and at the same time prove Anwar guilty.

The PM must lead by example if he wants the public to believe in our system of justice.

Chandran Sukumaran: Prime Minister Najib Razak, prove to the rakyat you are not afraid to face Anwar Ibrahim.
You do this and answer the court, you will win the general election hands down. You don't, and the rakyat will perceive you a man without guts and with a forked tongue.

Anonymous: As the PM has said that we are the most democratic country in the world, the judiciary should live up to the PM's claim.

Show the world that we really have the ingredients of a democratic nation - true separation of power. On that ground, the courts should rule without fear or favour.

Kanninneh: The judge will get the sack if he does not set aside the subpoenas. The outcome is expected. Every Malaysian knows this is just a sandiwara (show).

If all good men were to turn away from doing their public duty as witness in a court of law where is one's conscience and morality? Please go and tell the truth and shame the devil.

Rick Teo: Does Najib wants to see justice done? Why is he afraid to give evidence to prove he is not involved in the sodomy case?

Adelicia: His new adviser, the team behind Tony Blair's ‘New Labour' branding, should advise the couple to appear as witnesses at the ongoing trial to earn their ‘cool' image.

Their new advisers should take this opportunity to prove that they are worthy of the Malaysians' tax money to challenge branding guru Simon Anholt who described the PM's use of British firm FBC Media to burnish Malaysia's image abroad as an "absolute scam" and a waste of public funds", and "Countries that tend to spend most money on these PR campaigns to fix their image tend to be the rogue nations."

Muak: Striking out the subpoena is seriously not cool. The chief executive of the nation must stand up like a man and face the court. If he's innocent, there is nothing to fear.

Kelate: Anybody want to bet that the court will not allow the subpoena to set aside? Even a kindergarten kid will know which side to bet.


DNA expert insists lab not ISO17025-certified

Wira: Don't waste time on accreditation. Even if the lab is accredited, it does not necessarily mean it will do the right thing as shown in this case where the sperm cells were not isolated before the sample was tested.

ISO certification only means the facility generally complies to the requirements for certification. It does not mean the workers perform the correct procedures all the time.

Forget about the diversions. Focus on the important facts. It is crystal clear to most of us that government chemist Dr Seah Lay Hong did not isolate the sperm in the provided semen sample before conducting her DNA test.

From her testimony, she admitted that the DNA result (which contained Anwar's DNA) was from the total semen sample.

Her findings do not tell us whether the appropriate DNA comes from the sperm or from the cells inside Saiful's alimentary canal. If Saiful's DNA is detected to be coming from the sperm and not from the epithelial, then Saiful is guilty of adding Anwar's DNA to his own semen to frame the latter.

The reason why Dr Seah did not do an extraction to separate the cells before DNA testing is obvious to many of us as I don't believe an expert like her does not know the right procedure.

Anonymous_3e97: Either Dr Seah is really smart to purposely mess up the laboratory test to discredit the case and the prosecution team or she's a real fool and not able to perform the standard tasks expected of her. I prefer to believe she's smart.

Hmmmm: Instead of challenging the expert on what he said, the prosecutor is busy trying to find holes in his qualifications. If his qualifications are suspect, asking the right questions of his findings will soon reveal that. And vice versa. No need to challenge his qualifications directly.

Anonymous_3e4b: If strict international procedure is not adhered to, whatever results obtain is flawed by technicalities. Even if the Petaling Jaya lab is accredited, the lab results are useless from the start.

Quigonbond: Isn't the answer obvious? They got Anwar's DNA from somewhere, mixed it in a cocktail of Saiful's own sperm (because even amongst the conspirators, no one wanted to stoop so low as to offer the use of his sperm), and stuff it up Saiful's rectum. Then they claim that Anwar did Saiful.
