PKFZ: Chan Kong Choy wants case stayed

Former transport minister Chan Kong Choy, who was charged with cheating former prime minister Abdullah Ahmad Badawi over the Port Klang Free Zone (PKFZ) scandal, wants his case stayed, pending disposal of former transport minister Dr Ling Liong Sik’s cheating trial.

One of Chan's lawyers, Arthur Wang, told the Sessions Court that he filed the application this afternoon, to stay the proceedings, pending the disposal of Ling’s trial at the Kuala Lumpur High Court.
Ling's trial at the High Court resumed on Aug 1, until Aug 12.
Judge Azhaniz Teh Azman set Sept 12 to hear Chan’s application.
The judge also maintained the trial date which had been fixed from Sept 20 to 30, despite Wang’s application to postpone the date as their defence team was unavailable at that time.
Azhaniz said he would hear the application first and would decide on the trial date later. However, for now, he said the trial date should be maintained.
Earlier, deputy public prosecutor Nordin Hassan informed the court that the prosecution had submitted 50 documents related to the case to the defence team.
He said the defence requested for another 200 documents, but added the prosecution had to go through the documents and decide which of those were necessary to provide to the defence team.
Nevertheless, he said, the prosecution would provide the documents before the trial began.
Among the documents were minutes of Port Klang Authority (PKA) meetings from 1998 to 2008, and minutes of meetings of the Technical Cabinet and the Cabinet of Ministers.
On Feb 28, this year, Chan, 55 (centre in photo), pleaded not guilty to three counts of deceiving Abdullah into approving Kuala Dimensi Sdn Bhd (KDSB) as the turnkey developer to carry out development of the Transhipment Hub project in the Pulau Indah Free Zone and renovation works at the PKFZ site between 2004 and 2006.
Chan is accused of committing the offence in the fourth floor of the main block at the former prime minister’s office in Perdana Putra building in Putrajaya.
He faces a jail term of five years or a fine, or both on each of the three charges under Section 417 of the Penal Code, if convicted.
