Rosni Malan, widow of Baharuddin Ahmad who died during the Bersih 2.0 rally on July 9, has filed an application before the High Court in Kuala Lumpur for her husband's post-mortem report to be released by the Kuala Lumpur Hospital.

NONEThe family is also applying for the court to direct the magistrate's court to conduct an inquest into the death of Baharuddin and for the police to release all relevant documents relating to the case.

"The report should normally take about two weeks to be completed. The family requested for the report on July 12, but we have not gotten it yet," the family's lawyer Ahmad Jufliz Faiza said.

"Generally, we believe that Baharuddin (left) died within the area of police control (on that day). The post-mortem report is one of the items as evidence (in Baharuddin's case)."

Lawyers Patrick Dass, Chan Chew Weng and M Visvanathan are also acting for the family.

Accompanied by two of her three children, Rosni said that she wants an immediate inquiry into her husband's death.

"My intention is sincere. I have accepted Allah's decision, but my family and I must know how my husband died and who is responsible for his death," she said.

The move comes after a letter by the family to the Attorney-General's Chambers and Kuala Lumpur Magistrate Court on July 21 requesting for an inquest fell on deaf ears.

'My hubby was not ill'

Rosni also dismissed a video (below) aired by the police to the media allegedly showing Baharuddin alive at Avenue K, the location where Baharuddin was said to have suffered heart complications.

NONE"The video was very far away and it was not clear. I cannot identify who it is (for sure)," she said

She further stressed that her husband had no record of heart problems.

"My husband has always been healthy and there was never signs that he suffered any serious illness," she said.

Shortly after Baharuddin's death, police denied Baharuddin died as a result of complications from tear gas exposure, saying that the cause of death was a heart attack.

Chan raised the question as to how police could know Baharuddin's cause of death when the autopsy report had not yet been completed.

Baharuddin is believed to have fled about 300m across the road from KLCC to the Avenue K shopping complex, allegedly in an attempt to escape from tear gas fired during the July 9 rally. The actual circumstances of his death remain unclear.

NONE"The death certificate states that Baharuddin's cause of death is still pending laboratory analysis, so then how can the police say that he suffered a heart attack?" he said.

The family had claimed in an earlier police report that Baharuddin had suffered broken ribs and was missing a tooth.

That information was conveyed to Baharuddin's daughter, who is also a doctor at Kuala Lumpur Hospital.
