Frame-maker's assault case postponed

The ongoing trial of four cops accused of beating up a businessman last year was postponed, pending the prosecution’s application to merge the proceedings of the current case with another.

The four police officers, Mohd Azwan Hassan, Norzali Rosle, Mohd Saifullah Osman and Alizul Hafiz Mohd Ghafar, faced a joint charge under Section 323 of the Penal Code for allegedly voluntarily causing hurt to businessman Chia Buang Hing on Dec 18 last year.
When requesting for the trial to be postponed, deputy public prosecuter Amirah Mohd Yusof said that both cases involved an incident that occurred at the same place and at the same time.
“This is to avoid conflicting testimonies should the witnesses testify twice about the same incident,” she told magistrate Nik Mohd Fadhli Nik Azlan, who is presiding over the trial.
The prosecution filed the application at the Shah Alam High Court at 10am today to merge the trial of the four with another trial involving Norzali. The high court has set March 14 for case management of their application.
Norzali faces trial for another charge under Section 211 of the Penal Code, for making a false charge of an offence against Chia, with the intention of injuring him.
While another police officer, Mohadi Adam, was charged under Section 166 of the Penal Code for disobeying the law in order to cause harm to Chia.
R Vijayan, who represented Norzali, however left it to the wisdom of the judge.
Lead defence attorney for Mohd Azwan, Mohd Saifullah and Alizul Hafiz, lawyer Ahmad Zaharil Muhaiyar, however objected.
“There is no order by the court. We should proceed,” he argued.
Proceedings to resume on May 9, 10 and 11
Magistrate Nik Mohd Fadhli ruled that the case should be postponed pending the prosecution’s application to the Shah Alam High Court.
Proceedings shall resume on May 9, 10 and 11.
The trial which began yesterday, was supposed to resume today with Chia himself taking the stand to continue his testimony from yesterday.
The businessman was the second prosecution witness to be called to the stand yesterday, after the police photographer who photographed the scene of the alleged assault gave his testimony.
Chia (left) is alleging that on Dec 18 last year, he was beaten-up by the cops after he was stopped at a road block in Damansara Mutiara Petaling Jaya.
He is also claiming that the cops also robbed him of cash that he was carrying on him at the time, though the Attorney-General’s Chambers has still not decided to prosecute in the matter of the alleged theft.
