Four cops go on trial over beating of businessman

Four cops from the Kota Damansara Police Station, who are accused of beating up and robbing a businessman, went on trial at the Petaling Jaya magistrate’s court today.
Four cops from the Kota Damansara Police Station, who are accused of beating up and robbing a businessman, went on trial at the Petaling Jaya magistrate’s court today.
The four police officers, Mohd Azwan Hassan, Nozali Rosle, Mohd Saifullah Osman and Alizul Hafiz Mohd Ghafar, faced a joint charge under section 323 of the Penal Code for voluntarily causing hurt.
The accused were alleged to have caused bodily harm to businessman Chia Buang Hing on Dec 18 last year at a roadblock site on Jalan PJU 3/15 Persiaran Tropicana and while inside the Kota Damansara police station.
The trial started at 11am with deputy public prosecutor Amirah Mohd Yusof leading the prosecution, while lawyer Ahmad Zaharil Muhaiyar acted as lead defence counsel for all the accused.
Magistrate Nik Mohd Fadhli Nik Azlan presided over the case.
The first witness to be called today as the prosecution started its case was Lans Koperal Shahib Baba, 56, the police photographer who took several photographs of the Kota Damansara police station where the incident allegedly took place.
The prosecution quickly established that he took several photographs of the doorframe and toilet bowl inside the police station in question.
However, there was some question as to why the doorframe and room photographed by Shahib had the label ‘Bilik Repot’ or Report Room on its door, despite his instructions from investigating officer ASP Nasoha Ibrahim to photograph the MPB room.
To this the police photographer, who claimed that he was familiar with the station as he visited it often on duty, said that he knew because the room labelled room 10 when he entered it was indeed the room he recognised as the MPB room.
The defence queried Shahib further to verify that the only label on the door was ‘Bilik Repot’.
The police Lans Koperal then left the stand after identifying the four photographs he took and surrendering the original negatives to them. The negatives and photos were then tendered as evidence.
Victim is next witness
Next on the stand was the victim of the alleged assault, Chia himself. Chia related to the court in detail what happened to him on the night of Dec 18 last year.
The businessman repeated his allegations of how he was stopped by cops at a roadblock and was then beaten prior to having his money stolen, identifying all four of the accused as his assailants.
However, as he was not fluent in Malay, a Mandarin interpreter had to be used to convey to him the questions from the deputy public prosecuter and in turn translate his answers. This slightly prolonged the trial.
Chia (centre) was also quite spirited, speeding through his answers, causing the DPP to ask that he answer slowly and clearly.
His testimony took the bulk of today’s proceedings which ended at 5pm with the frame-maker’s testimony still at the halfway stage.
Chia was also asked to identify several other witnesses and individuals that were present during the incident.
The judge adjourned proceedings until 11.30am tomorrow.
