Prosecution attempts to change rules in mid-stream
'Isn't it the job of the prosecution to collect all the evidence and present them in court and the judge is supposed to be impartial?'
Yusof wants court to order Anwar to give DNA sample
Atan-Toyol: After being caught with illegally taking DNA samples from Anwar, the prosecution now wants the court to force Anwar to give his DNA. Imagine that.
Since you have bungled the entire investigation, you should concede defeat. Stop this entire ‘wayang kulit' and do something productive with your time and resources. Go for the big corrupt politicians who plundered this country, such as the one still on the loose in Kuching.
The Anwar Ibrahim case is so flawed from the beginning that even a law school dropout could see its defects.
Anonymous_3e2c: After Sodomy I, I told my friends it would always be difficult to say whether Anwar Ibrahim is actually a homosexual or not, since there were not enough evidence to proof it.
Now I am totally convinced it is a trumped-up conspiracy by the ruling government for one simple reason. Six years after his first sodomy charge, the prosecution could only come up with these so-called "evidence".
With cutting-edge technology at hand, Saiful could easily provide photographic evidence. If Anwar was indeed a sodomite as the BN government claims, they have 12 years since 1998 to catch Anwar in the act.
To the judges, the police, the ministers and the so-called expert witnesses, you can say anything you want, but I will not believe Anwar is guilty.
Bluemountains: Does solicitor-general II Mohd Yusof Zainal Abiden realised that he is in fact asking the judge to take sides? Is this what we have produced after 53 years of Umno rule?
Come to think of it, the judge may accede to his request like in so many other political cases such as in the illegal Perak power grab.
Ruben: Well, it clearly shows that investigating officer Jude Blacious Pereira is not at all a credible witness nor an officer who follows the right procedure when doing an investigation. He has proven to have lied on previous occasions.
The Suhakam inquiry findings are very damaging to his credibility. Furthermore, he clearly violated the IGSO's (Inspector General Standing Orders) procedure on storing the samples and kept them in his own cabinet. Anything could have been done to tamper the samples.
The manner in which DSAI (Anwar) was arrested and kept overnight was against the lock-up rules. Also, with the judge disallowing the DNA samples illegally collected from DSAI as evidence, the prosecution cannot link DSAI to the sodomy act in any way.
What else is needed to throw out the charges against DSAI?
Ferdtan: Jude Pereira deserved the thrashings from the defence lawyers as the answers he gave were clearly not too truthful. When it came to the part where he could not defend himself, he admitted to dereliction of duty without any remorse or care.
Pereira will go the way of the infamous judge, Augustine Paul.
Anonymous_4094: The prosecution wants the court to compel Anwar to provide sample for DNA profiling?
Isn't it the job of the prosecution to collect all the evidence and present them in court and fight it out with defendants, and the judge is supposed to be impartial and decide on the case based on what were presented before him?
Now the prosecution is asking the court for help to gather more evidence so that they can win the case. If the prosecution screwed up their case by not having enough evidence, the court should throw the case out, period. How can they ask the court to help them gather more evidence?
If the court allows this request, it will set a dangerous precedent for other cases and the prosecution can always ask the court's help to compel the accused (suspects) to provide whatever material/evidence required so the prosecution can win.
James Dean: If we take a closer look at what had happened from day one of this shameful episode, the police do not have any lawful evidence that link Anwar to this sodomy charge. All the evidence given in court up to this point did not point to Anwar. This case should not even have started in the first place.
Hovid: I thought they are starting to do some right thing and drop the case, but it looks like FLOM (First Lady of Malaysia) and hubby are not happy with the ruling for the trial-within-a-trial and ordered them to allow the bottle, toothbrush and towel to be used as evidence and at the same time, get DSAI to provide his DNA sample.
I recorded statement from PM, wife, says cop
Docs: Just when I thought Anwar's sodomy II case was turning out to be like one of those long-running Tamil dramas on Astro which had lost its plot, a new twist has been injected into this sodomy storyline to drum up public interest again.
Thank you IO (investigating officer) Supt Jude for tying Rosmah Mansor to Sodomy II. So many things are coming to my thoughts on why Pereira took Rosmah's statement? How is Rosmah involved? This is explosive.
Ghkok: Anwar Ibrahim is a victim of persecution and Amnesty International considers him a prisoner of conscience in 1998. Today, the persecution continues with a similar politically-motivated charge. After 12 long years, the tyrants are still going after him - with no remorse, no mercy, no compassion, no justice - except to stay in power after 53 years of one-party rule in this country.
This is what happens when you have a monopoly of power in a country. You get decay. It's time to transition to a two-party (coalition) system, to be cemented by a change to a new federal government.
Ponto: Lead counsel Karpal Singh should 'now go for the jugular and strictly adopt the 'take no prisoners' approach in questioning Pereira at the Anwar Ibrahim trial, as it's abundantly clear his 'weaving and bobbing' coupled with his hesitation in replying to the queries on PM Najib and his wife Rosmah, would serve as unerring indication of his non-cooperation and unreliability as a witness.
Such being the case, Karpal should recall Pereira to the witness stand and subject him to more strenuous and thorough grilling as it's only through such method of 'surgical dissection' that truth would glacially but surely exude.
To be candid, as no Malaysian under God's clear sky enjoys any immunity from the due process of our judiciary system, it would be deemed appropriate and opportune to call Najib and Rosmah take the witness stand and be likewise subjected to said grilling to dispel the general notion that the whole case is really not a hogwash.
SusahKes: Here's a revised Beatles' song (click here for original version):
Hey Jude, don't make it bad
Take Rosmah's song and make it better
Remember to let her into your heart
Then you can start to make it better
Hey Jude, don't be afraid
You were made to go out and get her
The minute you let her under your skin
Then you begin to make it better
Anonymous_3f94: If the defence has to make a case, then this (testimony by Pereira) allows them to call Rosmah as a witness. We live in interesting times. Don't bother to watch Dallas or Peyton Place - it's all here.
