Teoh's family boycotts RCI

Loverboy: It appears that the family of TBH are trying to get everything their way as suggested by some.

But I hope you would consider the following. The RCI was appointed by the Agong and its duty is investigative in nature to determine the cause of death of TBH.

I would accept the panel although some may disagree.

What I cannot accept are the DPP and the reason raised by Gobind on possible bias. In the review these DPP are moving for a suicide verdict and in the RCI they are suppose to assist the RCI.

Now James Foong, can you persuade the Malaysian public that these DPP are free from bias? Can they wear two hats when in another forum they are pushing for a suicide verdict and in the RCI they are to assist the RCI.

Common sense will tell you otherwise. The other issue, can you tell Malaysia why Dr  Pornthip is not called as a witness to testify in this RCI? Karpal you did right and I support the withdrawal from the RCI.

Not only will the commission run the risk of being contaminated by evidence, but will eventually fail to reach the 'real truth' and will be a waste of taxpayer money.

How could the panels in the RCI allow this proceedings to be compromised without due regards to the Teoh 's family. We Malaysians share this tragedy and fully support Teoh' family in the getting to the bottom of the 'TRUTH'.

I believe getting the truth is the main issue. What is a delay if it means a better chance at finding the truth?

Gerard Samuel Vijayan: The AG should withdraw the revision application in the High Court since it overlaps with the remit of the RCI. You cannot have two separate and distinct bodies attempting to determine the cause of Teoh's death.

There is a risk of arriving at inconsistent findings. The AG, if he wants to pursue a suicide verdict ought to lead evidence of this at the RCI.

The AG's fear is that the findings of the RCI even on suicide would not be binding and have the force of law as opposed to a revision order from the High Court.

The simple solution to this fear is to defer the revision application to a date after the conclusions of the RCI.

What the AG should avoid here is inconsistent findings of fact if he pursues both remedies at different forums.

At the end of the day any such inconsistency will only make a mockery of both the RCI and the High Court's order resulting in even more public anger and resentment at the perceived lack of credibility of both the RCI and High Court's findings.

Retnam: In the first place the RCI should not be formed until the court cases are disposed of. Najib rushed into forming the RCI for the Tenang election. He never considered the implications of the court case. Now it is clear that the RCI's sole purpose is to find a suicide verdict. If I am in the family's position I will do exactly the same thing.

Going by this line of thought, one would presume that the accused had already ejaculated once, is it then possible to ejaculate a second time into the mouth? Amaso: The KLH examination procedure is doubtful to layman on the street. Dr.Khairul Nizam was the person examining Saiful but another person, Siew, was responsible to fill up the medical pro-forma form and the form was not filled up in some aspects - rectal exam results which is crucial in the sodomy trial. The benefits of doubt should throw out this case.

HYL: I think they (Najib and gang) got scared by the riots in Middle East so now to avoid this from happening in Malaysia, changed from sodomy to oral sex! So the scapegoat is Saiful for false allegations! But Saiful will gladly accept this as his pocket will be full and all he has to do maybe just do a 1-month jail plus fines.


Sodomy II: Dent in prosecution case

josephine: Why are we not surprised by the shocking discrepancy revealed in the medical report. This turn of events has added credence to public perception that the prosecution's withholding evidence such as police statements, medical reports, chemist reports etc is to frustrate the process of justice and hinder the defence team from effectively defending Anwar.

I think, the defence team should now ask for ALL the documents to be made available to them, because, it is 99 percent likely that, more information that is favorable to Anwar are in those documents.

P.Dev Anand Pillai: If what the prosecution says is right, then Anwar must have be stronger than an ox, horse or even a camel! It will put all the UMNO men to shame as they do not have such strong organs which can penetrate through almost anything!

Yeap Cheng Liang: In a normal functioning democratic country, the case will not even reach the court. The IO would probably drop the case half way. But here in Malaysia, the 'victim' could just drop by at PM's office and even called up the IGP to complaint.

And now this guy can't even tell us whether he was enjoying or resisting from being penetrated. And worst still, he does not even know whether he was really raped.
