The Kuala Lumpur High Court (Appellate and Special Powers Division) has postponed a hearing to decide whether Section 15(5A) of the University and University Colleges Act (UCCA) is constitutional.

It involves four Universiti Kebangsaan Malaysia (UKM) students   accused of campaigning during the recent Hulu Selangor parliamentary by-election.

Judge Aziah Ali today deferred the hearing on the application of the Attorney-General's Chambers. The case will now be heard on Aug 2.

"The judge might decide on the fate of the students at the next hearing," said lawyer Ashok Kandiah, who is representing the four UKM students.

He also said the injunction granted to the ‘UKM 4'political science students on June 1 to stay  the university's disciplinary action against them will remain until the case is disposed off.

On June 17, an inter-parte hearing involving three plaintiffs-UKM,the government of Malaysia and the Higher Education Minister was held. 

The four were also suspended from the university's Political Science Club (KSP) for allegedly campaigning during the polls.

The four students - Muhammad Hilman Idham, Azlin Shafina Mohamad Adzha, Woon King Chai and Muhammad Ismail Aminuddin - on May 13 received their summonses to face a disciplinary hearing for contravening the UCCA.

The section reads: "No organisation, body or group of students of the university which is established by, under or in accordance with the Constitution, or any other organisation, body or group of students of the university, shall express or do anything which may be construed as expressing support, sympathy or opposition to - (a) any political party, whether or not it is in

Malaysia."

Muhammad Hilman and Azlin Shafina were arrested at Pekan Rasa on April 22, allegedly for possessing CDs and literature which "expressed support or sympathies" for a certain political party contesting in the by-election. Muhammad Ismail and Woon King Chai were arrested in Ampang Pecah the same day, in a van that contained political leaflets.
