The High Court here today fixed Feb 19 to hear the private summon case of the alleged seduction of celebrity television presenter Daphne Iking.

Judge Mohd Sofian Abd Razak set the date today after being informed by counsel Akhbardin Abdul Kader that they had not received the additional appeal record from the respondent, Darren Choy Khin Ming.
Company managing director Choy, 44, had appealed to the High Court on Aug 26, 2009 against the decision of the Magistrate's Court to reject his application for the case to be heard before another magistrate.
Iking's former husband, showbusiness producer Ryan Chong Yiing Yih, had filed a private summons against Choy for enticing Iking, 30, who was married to Chong then, with the intention of having illicit sex with her at The Plaza, Jalan Wan Kadir, Taman Tun Dr Ismail, Kuala Lumpur between July 2007 and September 2008.
In convicted under Section 498 of the Penal Code, Choy may be jailed for up to two years or face a fine, or both.
Last August, magistrate Mohd Faizi Che Abu allowed Chong to file the private summons after the public prosecutor decided not to proceed with the prosecution against Choy on the premise that it was private matter between a husband and wife.
On Dec 9, Choy made a bid to transfer the case to avoid prejudice on the grounds that Mohd Faizi had earlier heard the statement of complaint from Chong and issued the summons against him (Choy).
Choy also applied to refer to the High Court seven constitutional questions to determine whether the private summons against him was valid under the Federal Constitution.
Iking had married Chong, 31, on Jan 27, 2007 in Bali, Indonesia and they have a two-year-old daughter, Isobel Daniella. The couple, however, divorced last year.
