The Port Klang Authority (PKA) today filed a civil suit against its former general manager Phang Oi Choo for allegedly breaching her fiduciary, contractual and common law duties to the port authority during her tenure.

NONE"PKA contends that she had failed to exercise due care, diligence and skill in the discharge of her duties as the general manager of PKA," said PKA chairperson Lee Hwa Beng in a statement today.

He said she failed to comply with the Treasury guidelines and had failed to ensure that key agreements entered into by PKA contained adequate terms to safeguard its interest.

He also said that she had appointed a quantity survey firm associated with the Port Klang Free Trade Zone's (PKFZ) turn key developer Kuala Dimensi Sdn Bhd resulting in a conflict of interest.

NONEHe said that Phang (left) caused PKA to enter into further key agreements, which were not referred by her to the PKA board members for deliberation and approval, despite having full knowledge that such agreements would cause PKA financial distress.

He added that PKA was not in the position to finance the project at that point of time.

"The financial predicament faced by PKA was also not addressed in an appropriate and prompt manner," he said.

The suit was filed at the Shah Alam High Court.

He also said that the suit against Phang was in addition to the earlier actions taken by PKA, including the criminal reports made against her to the relevant authorities.

PKA is in a financial burden after its PKFZ project ran into high financial cost as a result of possible fraud including unsubstantiated claims and overcharging close to about RM1.6 billion by Kuala Dimensi.
