The High Court here today fixed Sept 29 for mention of the attorney-general's application to nullify the Selangor government's circular requiring its staff to help in the Malaysian Anti-Corruption Commission's (MACC) investigation only during office hours and

Deputy registrar Mohd Hafizi Abdul Halim fixed the date in chambers today to enable the AG to get copies of the application and affidavits filed by the Selangor government on Sept 4 to strike out his originating summons.
On Aug 20, attorney-general Abdul Gani Patail filed an originating summons seeking a declaration that the circular dated July 28 issued by Selangor state secretary Ramli Mahmud regarding the matter is null and void.
He named the Selangor government and the state secretary as defendants.
Senior federal counsel Azizah Nawawi represented the AG while counsel Yusmadi Yusoff represented the defendants.
Circular aimed at helping MACC
In his affidavit in support, Abdul Gani said that in view that the circular was an administrative directive, it was binding on all officers and staff of the Selangor government and if the circular was not complied with, it could be used as an excuse for disciplinary action against the officer or staff concerned.
The Selangor government, in its application to strike out the originating summons, claimed that the AG had no locus standi to start the proceedings and the appropriate party was the MACC because it was the party directly affected by the circular.
In his 55-page affidavit, Selangor Menteri Besar Abdul Khalid Ibrahim said, among others, that the circular was issued following advice from the state legal Advisor, Zauyah Be T Loth Khan, and was aimed at helping in the the MACC investigation and not otherwise.
He said the circular had to be issued because the state government's officers and staff had been continuously harassed and called up suddenly by the MACC demanding they hand over various documents, which eventually led to the sudden death of one of its staff, Teoh Beng Hock.
